1. Acceptance of Terms

By accessing or using FitByLena, you agree to these Terms of Service. If you do not agree, do not use the application.

These Terms apply to the website, application, demo, prototype, dashboard, account features, fitness content, checkout flows, uploads, and related services.

2. Demo and Portfolio Disclaimer

FitByLena may be a portfolio, prototype, demonstration, or testing project. It is provided for demonstration purposes only.

Features, accounts, workout plans, fitness programs, nutrition content, checkout flows, subscriptions, pricing, uploaded content, dashboards, and other data may be simulated, incomplete, inaccurate, experimental, or subject to change.

You should not use this application for real purchases, medical decisions, professional fitness decisions, nutrition decisions, legal decisions, financial decisions, or storing sensitive information unless the application clearly states that it is a live production service.

We may modify, suspend, reset, or discontinue the application at any time without notice.

3. No Medical, Fitness, or Nutrition Advice

FitByLena does not provide medical advice, diagnosis, treatment, physical therapy, professional fitness training, nutrition counseling, or emergency health services.

Any workout, wellness, fitness, meal, nutrition, progress, or lifestyle information displayed in the application is provided for general informational and demonstration purposes only.

You should consult a qualified physician, trainer, dietitian, or other appropriate professional before starting a workout program, changing your diet, using supplements, or making health-related decisions.

Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, chest pain, faintness, or any concerning symptoms.

4. Stripe, Payments, and Demo Checkout

FitByLena may include Stripe checkout, subscriptions, pricing, billing, invoices, customer portal flows, or payment-related features for demonstration or testing purposes.

Unless the application clearly states that live payments are enabled, checkout flows, subscriptions, prices, invoices, billing portals, and payment confirmations may be simulated or handled in Stripe test mode.

Demo checkout flows do not guarantee access to real products, services, coaching, memberships, digital content, or subscriptions.

Do not enter real payment information into demo or test-mode checkout flows. If live payments are enabled in the future, payment processing will be handled by Stripe and may be subject to Stripe's own terms and privacy policy.

5. User Accounts and Login

Some features may require an account or OAuth login. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

• Do not share your account with unauthorized users.
• Do not attempt to access another user’s account.
• Do not bypass authentication or security controls.
• Do not use the application for unlawful, abusive, or harmful purposes.

We may suspend or remove accounts that violate these Terms or create security, legal, or operational risks.

6. User Content and Uploads

You may be able to submit, upload, or create content, including text, profile information, fitness goals, preferences, progress notes, images, files, documents, messages, or feedback.

You are responsible for any content you submit. You represent that you have the rights necessary to submit and use that content.

• Do not upload content that violates any law.
• Do not upload content that infringes intellectual property rights.
• Do not upload malware or harmful code.
• Do not upload medical records, protected health information, or sensitive personal information that should not be used in a demo.
• Do not upload abusive, threatening, hateful, discriminatory, or harassing content.
• Do not upload false, misleading, or fraudulent content.
• Do not upload content that violates the privacy or rights of others.

By submitting content, you grant us permission to use, store, process, display, and transmit that content as needed to operate, test, and improve the application.

7. Acceptable Use

• Do not attack, disrupt, overload, or interfere with the application.
• Do not attempt to reverse engineer or bypass security features.
• Do not scrape, harvest, or misuse data.
• Do not upload malicious files or code.
• Do not use automated tools in a way that harms the service.
• Do not abuse checkout flows, rate limits, authentication systems, or demo accounts.
• Do not use the application for illegal, harmful, deceptive, or unauthorized purposes.

8. Fitness Content and Results

FitByLena does not guarantee any specific physical, health, weight-loss, strength, appearance, performance, or wellness results.

Fitness outcomes vary based on many factors, including health, consistency, diet, sleep, genetics, experience, and personal circumstances.

9. Third-Party Services

The application may rely on third-party services for hosting, authentication, databases, storage, payments, analytics, email, logging, or other functionality.

We are not responsible for third-party services, their availability, their content, or their handling of data except as described in our Privacy Policy. Your use of third-party services may also be subject to their own terms and privacy policies.

10. Privacy

Your use of the application is also governed by our Privacy Policy, which explains how information may be collected, used, stored, and shared.

By using the application, you agree to the Privacy Policy.

11. Intellectual Property

The application, including its design, code, branding, content, layout, features, and functionality, is owned by Christian Roubideaux or its licensors, unless otherwise stated.

You may not copy, modify, distribute, sell, or exploit any part of the application without permission.

12. Availability and Changes

The application may be unavailable, interrupted, changed, suspended, or discontinued at any time.

We do not guarantee that the application will be secure, error-free, uninterrupted, or available at all times.

13. Disclaimer of Warranties

The application is provided “as is” and “as available” without warranties of any kind, whether express or implied.

We disclaim all warranties, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, and security.

14. Limitation of Liability

To the maximum extent permitted by law, Christian Roubideaux will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, profits, revenue, business, goodwill, health outcomes, fitness outcomes, payment-flow issues, or use arising from or related to the application.

Your use of the application is at your own risk.

15. Indemnification

You agree to defend, indemnify, and hold harmless Christian Roubideaux from claims, damages, liabilities, losses, costs, and expenses arising from your use of the application, your submitted content, your violation of these Terms, your use of fitness content, or your violation of any law or third-party rights.

16. Termination

We may suspend or terminate your access to the application at any time if we believe you violated these Terms, created risk, or used the application in an unauthorized or harmful way.

17. Governing Law

These Terms are governed by the laws of the United States and the applicable laws of the state where the application owner resides, without regard to conflict-of-law principles.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the application after changes are posted means you accept the updated Terms.
